Photographs, illustrations, renderings, floor plans, specifications, dimensions, product images, colors, materials, features, and project descriptions may be examples or representative images. Actual materials, finishes, dimensions, availability, construction methods, and completed work may vary.
CB Moore may correct errors, update information, change its offerings, or remove Website content at any time without prior notice.
## 4. Contact and Estimate-Request Forms
The Website may allow visitors to submit contact requests, project information, photographs, plans, property information, and estimate requests.
Submitting a contact form, estimate-request form, project inquiry, or similar communication:
1. Does not create a construction contract or other binding service agreement;
2. Does not require CB Moore to accept or perform the requested work;
3. Does not guarantee pricing, availability, scheduling, permitting, financing, or project feasibility;
4. Does not reserve a project start date;
5. Does not establish a fiduciary, design-professional, or confidential relationship; and
6. Does not constitute acceptance of a construction project by CB Moore.
CB Moore may contact you to request additional information, arrange a consultation, schedule a site visit, or provide a preliminary estimate.
Any estimate provided in response to a Website submission is preliminary unless expressly identified in writing as a binding proposal or fixed-price contract.
An estimate may change after review of plans, property conditions, site access, soil conditions, surveys, engineering requirements, permitting requirements, building codes, customer selections, material costs, subcontractor pricing, concealed conditions, or other project-specific information.
A binding construction or service relationship is created only when the parties execute a separate written agreement or CB Moore expressly confirms acceptance of an online service order.
## 5. Products and Services
CB Moore may offer physical products, construction-related products, consultation services, inspections, planning services, construction services, project-related services, or other goods and services through the Website.
All products and services are subject to availability.
CB Moore may:
* Limit the quantity of products or services purchased;
* Restrict sales or services by geographic area;
* Refuse or cancel an order when reasonably necessary;
* Discontinue products or services;
* Correct pricing or description errors;
* Require additional documentation;
* Require a separate written agreement;
* Decline projects outside its service area or capabilities; or
* Decline work because of scheduling, permitting, safety, licensing, site, financial, or other legitimate business considerations.
Placing an order constitutes an offer to purchase. An automated email or Website confirmation only acknowledges receipt of the order and does not necessarily mean the order has been accepted.
CB Moore may accept an order by sending an acceptance notice, processing payment, beginning the service, shipping the product, scheduling the work, or otherwise confirming acceptance.
If CB Moore cancels an order after payment has been collected, CB Moore will refund the amount paid for the canceled portion, less any properly earned charges, completed services, nonreturnable materials, special-order costs, or other amounts authorized by a separate agreement.
## 6. Construction and Project Services
Construction, remodeling, repair, design coordination, site work, project management, material procurement, and related services may require a separate written contract.
Unless expressly stated otherwise during checkout, an online payment for services may represent:
* A consultation fee;
* An inspection fee;
* An estimate or planning fee;
* A design or preconstruction fee;
* A scheduling or reservation payment;
* A deposit;
* A material payment;
* A progress payment; or
* Payment for another specifically described service.
An online transaction does not replace a required construction agreement, proposal, scope of work, change order, warranty document, financing agreement, statutory disclosure, or other project-specific document.
If these Terms conflict with a separately signed construction or service agreement, the separately signed agreement controls regarding the applicable project or service.
Customer-requested changes to construction work must be documented and approved according to the applicable construction agreement.
Website messages, form submissions, emails, text messages, photographs, or informal conversations do not automatically constitute an approved change order.
## 7. Estimates and Proposals
An estimate is not a guarantee of the final project price unless CB Moore expressly identifies it as a binding fixed-price proposal.
Estimates are based on the information available when they are prepared and may be revised because of:
* Changes in project scope;
* Customer selections;
* Material price increases;
* Labor cost changes;
* Subcontractor pricing;
* Site conditions;
* Concealed or unexpected conditions;
* Permit or inspection requirements;
* Engineering or architectural requirements;
* Code requirements;
* Utility requirements;
* Weather delays;
* Taxes, tariffs, freight, or fuel charges; or
* Other project-related conditions.
Unless otherwise stated, an estimate does not include work, products, materials, services, fees, or conditions that are not specifically identified in the estimate.
Estimates and proposals may have an expiration date. CB Moore may revise or withdraw an estimate that has expired or has not been accepted according to its terms.
## 8. Prices
Prices displayed on the Website are stated in United States dollars unless otherwise specified.
Displayed prices may exclude:
* Sales and use taxes;
* Delivery and shipping charges;
* Permit fees;
* Inspection fees;
* Architectural or engineering fees;
* Surveying fees;
* Site preparation;
* Utility charges;
* Freight or fuel surcharges;
* Disposal fees;
* Installation;
* Special-order materials;
* Processing fees where legally permitted and disclosed; and
* Other project-specific expenses.
CB Moore reserves the right to correct pricing, calculation, description, inventory, or typographical errors before accepting an order.
If an incorrect price is discovered after an order is submitted, CB Moore may contact you for approval of the corrected price or cancel and refund the affected portion of the order.
## 9. Payments
You agree to pay all charges associated with an accepted order according to the prices and payment terms presented during checkout, on an invoice, in a proposal, or in the applicable written agreement.
By providing payment information, you represent that:
1. You are authorized to use the payment method;
2. The payment information is accurate;
3. CB Moore and its payment processor may charge the authorized amount; and
4. You are responsible for applicable taxes, fees, shipping charges, and other disclosed costs.
Payments may be processed by an independent payment-processing provider. CB Moore may not directly receive or store complete payment-card information.
A payment is not considered final until it has cleared and is no longer subject to reversal, dishonor, dispute, or chargeback.

This provision does not eliminate any rights available under applicable consumer-protection, banking, or payment-card laws.
Returned payments, declined transactions, or unauthorized chargebacks may result in suspension or cancellation of an order or service and may be subject to fees permitted by law or by a separate written agreement.
## 10. Deposits and Progress Payments
Deposits, retainers, reservation payments, material payments, and progress payments for construction or service work are governed by the applicable checkout disclosure, proposal, invoice, or written agreement.
Unless expressly stated otherwise, paying a deposit does not guarantee a specific project start or completion date.
Scheduling may depend on:
* Contract execution;
* Permitting;
* Inspections;
* Material availability;
* Weather;
* Subcontractor availability;
* Site readiness;
* Customer selections;
* Financing;
* Utility availability;
* Engineering or design completion; and
* Other circumstances affecting the project.
The refundability of a deposit will be determined by the applicable written agreement and any rights provided by law.
## 11. Product Orders and Availability
Product availability may change without notice.
CB Moore does not guarantee that every product displayed on the Website is in stock or available in the quantity requested.
Manufacturers, distributors, and suppliers may discontinue or modify products, colors, specifications, model numbers, packaging, and availability without notice.
When a product becomes unavailable, CB Moore may:
* Cancel and refund the affected item;
* Offer a comparable replacement;
* Provide a revised delivery date;
* Request approval for a substitution; or
* Provide another reasonable option.
CB Moore will not make a substitution that materially changes an accepted construction scope without obtaining approval when approval is required by the applicable agreement.
## 12. Shipping and Delivery
Shipping and delivery dates are estimates unless CB Moore expressly guarantees a date in writing.
CB Moore will make commercially reasonable efforts to ship products within the timeframe represented during checkout or in the applicable order confirmation.
When CB Moore cannot ship within the stated or legally applicable timeframe, CB Moore may:
* Provide a revised shipping date;
* Request your consent to the delay;
* Offer a comparable substitute;
* Allow cancellation of the unshipped item; or
* Issue a refund for the canceled or unshipped portion of the order.
Risk of loss and title to physical products transfer as provided by applicable law and the stated shipping terms.
You are responsible for providing a complete and accurate delivery address.
CB Moore is not responsible for delays or losses caused by an incorrect address supplied by the customer, refusal of delivery, failure to retrieve a package, or inability of the carrier to access the delivery location.
Visible shipping damage, shortages, or incorrect items should be reported to CB Moore within five business days after delivery at:

You should retain the product, packaging, shipping label, photographs, receipt, and other documentation needed to investigate a delivery claim.
Failure to report a shipping issue promptly may affect CB Moore’s ability to submit a carrier or supplier claim, but it does not eliminate customer rights that cannot legally be waived.
Additional shipping provisions may be contained in a separate Shipping Policy available on the Website. The Shipping Policy is incorporated into these Terms by reference.
## 13. Cancellations, Returns, and Refunds
Product returns, exchanges, and refunds are governed by the Refund and Return Policy available on the Website.
Service cancellations are governed by the applicable checkout terms, proposal, invoice, or separate written agreement.
The following may be nonreturnable or subject to cancellation charges when permitted by law and disclosed to the customer:
* Custom products;
* Personalized products;
* Special-order materials;
* Clearance or final-sale products;
* Opened or used products;
* Installed products;
* Damaged products not caused by CB Moore;
* Design or planning work;
* Permitting or application fees;
* Completed consultations;
* Completed services;
* Materials purchased specifically for a customer;
* Delivery or restocking fees; and
* Work already performed.
Nothing in these Terms limits a customer’s cancellation, refund, warranty, or other rights that cannot legally be waived.
## 14. Product Descriptions
CB Moore attempts to describe products and services accurately. However, CB Moore does not guarantee that every description, photograph, color, specification, measurement, price, availability statement, or listing is complete, current, or error-free.
Computer screens and mobile devices may display colors differently from the actual product.
Natural and manufactured materials may vary in appearance. These materials may include:
* Wood;
* Stone;
* Brick;
* Tile;
* Concrete;
* Countertops;
* Flooring;
* Paint;
* Roofing;
* Siding; and
* Other construction materials.
Variations in grain, pattern, shade, texture, size, color, or appearance may not constitute a defect when the variation is normal for the product or material.
You are responsible for reviewing product specifications and confirming that a product is appropriate for its intended use before purchase or installation.
## 15. Customer Selections and Measurements
You are responsible for reviewing and approving customer selections, specifications, colors, finishes, quantities, layouts, and measurements when approval is requested.
Measurements submitted through the Website are preliminary unless verified by CB Moore or an authorized representative.
CB Moore is not responsible for errors caused by incorrect measurements, plans, photographs, descriptions, specifications, or other information supplied by the customer or a third party.
Additional costs caused by inaccurate customer-supplied information may be charged as provided in the applicable agreement.
## 16. Warranties
Products and services may be covered by warranties specifically provided by CB Moore, a manufacturer, a supplier, or a separate written agreement.
Any applicable warranty will be identified in the relevant product documentation, invoice, proposal, construction agreement, service agreement, or warranty document.
Except as expressly stated in a separate written warranty, and to the fullest extent permitted by law, the Website and its general content are provided on an “as is” and “as available” basis.
CB Moore disclaims implied warranties relating solely to Website operation, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement, to the extent those warranties may legally be disclaimed.
This Website disclaimer does not eliminate:
* Warranties expressly provided in writing;
* Manufacturer warranties;
* Warranties contained in a signed construction or service agreement; or
* Warranties and consumer rights that cannot legally be excluded.
## 17. Permits, Codes, Plans, and Property Conditions

* Zoning requirements;
* Homeowners’ association requirements;
* Easements;
* Restrictive covenants;
* Utility requirements;
* Environmental requirements;
* Inspections;
* Engineering decisions;
* Architectural requirements;
* Manufacturer instructions;
* Soil conditions;
* Drainage;
* Property boundaries;
* Site access; and
* Concealed or unexpected conditions.
Unless otherwise agreed in writing, Website content does not represent or guarantee that:
* A particular plan can be constructed on a specific property;
* A project will receive governmental or association approval;
* A product is suitable for every installation;
* A property is suitable for development;
* Utilities are available;
* Soil or environmental conditions are suitable;

Project-specific obligations regarding permits, plans, site conditions, and code compliance will be addressed in the applicable construction or service agreement.
## 18. Customer-Submitted Materials
When you submit photographs, plans, drawings, surveys, specifications, measurements, descriptions, reviews, testimonials, or other materials through the Website, you represent that:
1. You own the materials or have permission to submit them;
2. The submission does not violate another person’s intellectual-property, privacy, confidentiality, or contractual rights;
3. The information is accurate to the best of your knowledge;
4. The submission does not contain malicious software; and
5. The submission is not unlawful, fraudulent, threatening, defamatory, obscene, or otherwise prohibited.
You grant CB Moore a nonexclusive, royalty-free license to use submitted materials as reasonably necessary to:

* Prepare an estimate;
* Communicate with you;
* Process an order;
* Coordinate a project;
* Perform requested services;
* Maintain business records; and
* Comply with legal obligations.
CB Moore will not use customer project photographs or personally identifying information for advertising when permission is required by law or contract unless the required permission has been obtained.
Do not submit Social Security numbers, complete banking information, medical information, passwords, confidential trade secrets, or other highly sensitive information through a general contact or estimate form.
## 19. Reviews and Testimonials
When you submit a review or testimonial, you represent that it reflects your honest experience and opinions.
You grant CB Moore permission to reproduce, publish, format, shorten, and display the review or testimonial for lawful business and marketing purposes, subject to applicable privacy laws and any separate written agreement.
CB Moore may decline to publish or may remove submissions that contain:
* False information;
* Confidential information;
* Personal contact information;
* Profanity;
* Threats;
* Harassment;
* Discrimination;
* Unlawful content;
* Spam;
* Advertising for unrelated businesses; or
* Content that violates another person’s rights.
CB Moore will not knowingly alter a review in a manner that materially misrepresents the reviewer’s opinion.
## 20. Acceptable Website Use
You may not use the Website to:
* Violate any law or regulation;
* Submit false, fraudulent, misleading, or impersonated information;

## 28. Limitation of Liability
To the fullest extent permitted by law, CB Moore and its members, managers, employees, representatives, subcontractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from:

* Reliance on general Website content;
* Website interruptions or errors;
* Unauthorized access to information despite reasonable safeguards;
* Third-party websites or services; or
* Products or services not expressly accepted by CB Moore.
For claims arising solely from Website use or an online transaction that is not governed by a separate signed agreement, CB Moore’s total liability will not exceed the greater of:
1. The amount paid through the Website for the transaction giving rise to the claim; or
2. One hundred dollars.
This limitation does not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, gross negligence, or personal injury when applicable law prohibits limitation.
Claims involving construction or services governed by a separate signed agreement are subject to the liability provisions contained in that agreement.
## 29. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless CB Moore and its members, managers, employees, representatives, and agents from third-party claims, damages, liabilities, costs, and reasonable attorneys’ fees arising from:
* Your unlawful use of the Website;
* Your violation of these Terms;
* False or unauthorized information submitted by you;
* Materials submitted by you that infringe another person’s rights;
* Your fraudulent or unauthorized transaction; or
* Your misuse of a product purchased through the Website.
This provision does not require you to indemnify CB Moore for CB Moore’s own negligence, willful misconduct, or violation of law.
## 30. Informal Dispute Resolution
Before filing a lawsuit relating solely to Website use or an online purchase, the complaining party should provide written notice describing:
* The nature of the dispute;
* The relevant order, service, or transaction;
* The requested resolution; and

The parties will make a good-faith effort to resolve the dispute informally for at least thirty days after receipt of the notice.
This informal-resolution requirement does not prevent either party from:
* Seeking emergency injunctive relief;
* Preserving a statute of limitations;
* Filing or preserving a lien or bond claim;
* Responding to a lawsuit or legal proceeding;
* Reporting conduct to a governmental authority; or
* Exercising rights that cannot legally be restricted.
Disputes governed by a separate construction or service agreement will be handled according to that agreement.
## 31. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Subject to applicable consumer-protection laws and any separate signed agreement, legal proceedings relating solely to these Terms or Website use must be brought in a state or federal court having jurisdiction in Wake County, North Carolina.
Nothing in these Terms deprives a consumer of protections that cannot lawfully be waived under applicable law.
## 32. Force Majeure
CB Moore will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including:
* Severe weather;
* Hurricanes;
* Floods;
* Fire;
* Natural disasters;
* Epidemics or public-health emergencies;
* Labor disruptions;
* Material shortages;
* Supply-chain disruptions;
* Transportation delays;
* Utility outages;
* Governmental actions;
* Permit or inspection delays;
* Cyberattacks;
* War;
* Civil unrest;
* Carrier failures;
* Supplier failures; or
* Other circumstances beyond CB Moore’s reasonable control.
This section does not eliminate any refund, cancellation, notice, or other obligation that cannot legally be waived.
## 33. Changes to These Terms
CB Moore may revise these Terms periodically.
Updated Terms will be posted on the Website with a revised “Last Updated” date.
Changes apply prospectively unless applicable law permits otherwise.
The Terms in effect when an order is accepted generally govern that order unless the parties agree otherwise in writing.
Continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
## 34. Suspension and Termination
CB Moore may suspend or terminate access to the Website because of:
* Violation of these Terms;
* Fraud or suspected fraud;
* Website misuse;
* Security threats;
* Nonpayment;
* Chargeback abuse;
* Unlawful conduct; or
* Other lawful business reasons.
Termination does not affect:
* Existing payment obligations;
* Accepted orders;
* Intellectual-property rights;
* Warranty obligations;
* Dispute-resolution provisions; or
* Other provisions that by their nature should survive termination.
## 35. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary or severed.
The remaining provisions will continue in full force and effect.
## 36. No Waiver
Failure by CB Moore to enforce a provision of these Terms does not waive its right to enforce that provision or another provision later.

## 37. Assignment
You may not assign or transfer your rights or obligations under these Terms without CB Moore’s prior written consent.
